NO FCRA USE. Mercer County Criminal History is privately operated and has no government affiliation. It and its advertising partners do not provide services for credit, employment, tenant, insurance, or any other decision regulated by the Fair Credit Reporting Act. This is a West Virginia records reference, not a private investigation firm or consumer reporting agency.
1. What This Website Is
This private reference site is independent of all government offices. It neither stores official criminal files nor retrieves records, performs official checks, or submits documents for a visitor.
Its purpose is to identify custodians of Mercer County records, including the sheriff, local courts, West Virginia State Police CIB, WVDCR, and the West Virginia Sex Offender Registry, and to provide links to outside research tools.
2. Rules for Using This Site
As a condition of use, you agree not to:
- Use bots, scrapers, or other automated access tools
- Interfere with site performance or another visitor's access
- Attempt unauthorized entry into any system or account
- Use information to stalk, threaten, or harass a person
- Rely on site content for a decision regulated by the FCRA
- Violate federal, West Virginia, or local law
3. No Harassment, Stalking, or Discrimination
Information obtained here or through a linked tool may not be used to stalk, intimidate, threaten, harass, or unlawfully discriminate. West Virginia Sex Offender Registry data carries an express warning against threats and harassment under the state's registration law. It exists for public-safety awareness, never vigilante action or an unlawful decision about another person.
4. We Are Not a Consumer Reporting Agency
We are not a consumer reporting agency under the FCRA and do not create credit reports, background reports, or consumer reports. You may not use information from this site or a linked tool to:
- Make an employment decision
- Evaluate a housing application
- Set credit or insurance terms
- Determine eligibility for a license, permit, or public benefit
- Carry out any other FCRA-regulated purpose
A legally required official process must go through West Virginia State Police CIB, the authorized fingerprint channel, or a provider that complies with the FCRA.
5. No Legal Advice
The material is general information, not legal advice. A licensed West Virginia attorney must assess how a warrant, charge, conviction, sentence, or expungement law applies to particular facts.
6. No Warranties
All content and services are offered "as is." No promise is made that:
- A partner's search result will be complete or correct
- Every page will be free from bugs or security flaws
- The website will remain continuously available
- Published information will always be current, accurate, or complete
Charges, case outcomes, custody status, and access restrictions can change. Delays and gaps are unavoidable, and nothing here is an official statement by a court, sheriff, police agency, or state office.
7. Third-Party Services and Links
Links lead to government offices, court systems, legal resources, and outside search services that we do not operate. We are not responsible for a destination's content, availability, prices, or data practices. Its own terms govern use.
8. Intellectual Property
Mercer County Criminal History or its content partners own the site's text, code, graphics, and logos. Written permission is required to copy, modify, distribute, or create derivative material.
9. Limits on Our Liability
To the greatest extent allowed by law, we are not responsible for damages arising from use of the website or reliance on information from it or a linked service.
10. Indemnification
You agree to indemnify and hold us harmless from claims, demands, proceedings, legal fees, and related costs caused by your use of the site or violation of these conditions.
11. Governing Law
West Virginia law governs these terms. Any dispute arising from use of the website must be brought in a court located in West Virginia.
12. Changes to These Terms
We may revise these conditions. A new version becomes effective when it is posted on this page.
13. Cutting Off Access
Access may be restricted or ended at any time, for any reason, and without advance notice.
14. Severability
If one provision is held invalid or unenforceable, the remaining provisions continue in force. The affected language will be changed only as far as needed to make it enforceable.
15. Questions
Questions about these conditions can be directed through the Contact page.
